Overview

MCM Acoustical Inc. (“MCM Acoustical”, “we”, “our” and “us”) is committed to maintaining the accuracy, confidentiality and security of the information we obtain from you when you visit our website. MCM Acoustical’s Website Privacy Policy (“this Policy”) guides us in the collection, use, retention and disclosure of your information.  MCM Acoustical is a manufacturer of acoustic wood ceiling and wall panels, located in Mississauga, Ontario.

This Policy applies to MCM Acoustical and all:

  • officers and directors of MCM Acoustical;
  • employees of MCM Acoustical;
  • contractors and agents engaged by MCM Acoustical.

All such persons and entities are hereinafter referred to as “MCM Acoustical.”

Personal information means information about an identifiable individual, but does not include the name, title or business address or telephone number of an employee of an organization. Personal information includes particulars as to birth date, race, ethnic origin, colour, age, marital status, religion, education, medical, criminal, employment and financial history, address, telephone number, Social Insurance Number, fingerprints, blood type, tissue or biological sample, views or personal opinions.

Why Do We Collect, Use and Disclose Your Information?

MCM Acoustical collects personal information to allow us to manage, maintain and develop our business and operations. We use non-personal information to track your use of our website in an effort to evaluate, maintain and improve our website.

What Personal Information Do We Collect?

MCM Acoustical collects and maintains personal and non-personal information from the individuals who visit our website.

  • With our parent company, Millwork Custom Manufacturing (2001) Inc. (“MCM 2001”);

  • Where disclosure to a third party is required, in which case your consent would be implied;
  • Where the information is already publicly known.

When Do We Disclose Your Information?

We may share your personal and non-personal information with our employees, contractors, consultants and other parties who require such information to help us manage and improve our relationship with you, including third parties whose services we use to conduct our business. It is important to us that we collect, use or disclose your information where we have your consent to do so. Depending on the sensitivity of the information, your consent may be express, implied or deemed. Express consent can be given orally, electronically or in writing. Implied consent is consent that can reasonably be inferred from your actions or inactions.

We may collect, use or disclose your information without your knowledge or consent where we are permitted or required to do so by applicable law.

Deemed Consent

Unless you advise us otherwise, we assume that you have consented to the collection, use and disclosure of your information as set out in this policy.

You can withdraw your consent for the use of your personal information at any time, subject to legal restrictions and upon reasonable written notice to MCM Acoustical. We will let you know the implications, if any, of withdrawing your consent.

Employees

Employee records will be collected, used, disclosed and retained in accordance with this Policy.

It is our standard practice to retain applications for positions at MCM Acoustical, whether or not the applicant is successful in securing employment with us. If you do not want us to keep a file regarding your application, please contact our Privacy Officer with a written request.

Security

Personal information is confidential and private. MCM Acoustical takes appropriate administrative, technical, physical, and organizational security measures to protect your personal information from loss, theft, unauthorized access and collection, use, disclosure, alteration, destruction and modification of personal information.  MCM Acoustical follows industry standards to protect the personal information submitted to us both during transmission and once it is received. All employees of MCM Acoustical are informed of our privacy practices and understand that they must adhere to our established privacy principles when collecting, using or disclosing personal information.

While MCM Acoustical has taken reasonable steps to secure the personal information provided to us, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against interception or other types of misuse.

Access

Your personal information belongs to you. You have a right to request access to this information at any time. MCM Acoustical may not be able to provide you with access to your personal information where prescribed by law: for example, where the information cannot be separated from the records of others; where it cannot be disclosed for reasons of security or confidentiality; or where it is protected by legal privilege.

Accuracy

To serve you better, MCM Acoustical wants to ensure that the personal information it has in its possession is complete, accurate and up-to-date. We will use reasonable efforts to update your information. Please contact us to make any changes to the personal information we have on file.

Retention

We will retain your personal information for as long as needed to fulfill the purpose for which we collected it and for a reasonable period thereafter to comply with audit, contractual, or legal requirements, or where we have a legitimate business interest in doing so. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We may retain aggregated or de-identified data indefinitely or to the extent allowed by applicable law. We may retain personal information preserved in computer backups or archival copies generated in the ordinary course of our information technology systems procedures.

Children

MCM Acoustical does not knowingly collect personal information from children under age 16 for any purpose. If we learn that we have collected personal information of a child under age 16, we will attempt to delete that personal information as soon as possible and take any other measures required under applicable law.

MCM Acoustical reserves the right to make changes to its privacy policy from time to time. All personal information collected, used, disclosed or retained by MCM Acoustical will be governed by the privacy policy in effect at that time. We will ensure that any new versions of this policy will be posted on the MCM Acoustical website. Cookies and Similar Tracking Technologies

MCM Acoustical’s websites use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Data Processing in Other Countries

Your personal information may be collected, used, processed, transferred, and retained in multiple countries including in Canada, the United States, and the European Union. These countries may be outside your region and may be subject to different privacy and data laws.

Additionally, and as discussed above, we may also engage third parties to perform services on our behalf.  These third parties may store, process and transfer personal information to jurisdictions that may not provide the same levels of data protection as your home jurisdiction. These third parties may also be required to share information in response to valid demands and requests from governments, courts, or law enforcement according to laws in those jurisdictions. Subject to applicable laws in such other jurisdictions, we will use reasonable efforts to ensure that appropriate safeguards are in place.

For residents of Quebec, we will only transfer your personal information outside of Quebec for the purposes identified in this Policy, with your consent or in accordance with applicable laws.
